The actual drawing is scheduled to be held on June 1st , 2010, 5:00 p.m. CST. winner need not be present to win. The Official Rules of the raffle are set forth herein. By entering the raffle, all entrants agree to be fully and unconditionally bound by these Official Rules, waive any right to claim ambiguity in the raffle or these Official Rules and further agree to be bound by Florida Home Raffles, LLC.'s decisions and interpretation of these Official Rules. By entering, all entrants release Florida Home Raffles, LLC, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies from any liability. 1.ELIGIBILITY: Drawing open only to residents of the U.S. age 18 or older at the time of entry to purchase tickets, be a ticket holder, or win a prize. An affidavit of eligibility, photo identification, taxpayer identification number, and other information will be required from prize winners. Void where prohibited. 2. HOW TO PURCHASE To enter, a ticket can be obtained from Florida Home Raffles at the following internet website: www.floridahomeraffles.com. Must provide a valid email address, full legal name, home phone, alternate phone, physical address and mailing address. Tickets and payment confirmation will be sent electronically by email. Ticket purchases are not tax deductible in accordance with IRS regulations. No refunds are available unless the requisite 6,000 tickets are not sold and all ticket sales are otherwise final. In the event all tickets are not sold at the sole discretion of Florida Home Raffles, LLC one of the following will occur: 1. Raffle draw date may be rescheduled 60 days from the originally scheduled date. 2. Refunds issued to all ticket purchasers. 3. Raffle may occur as scheduled. 2.1 TICKET PACKAGES Buy (1) Florida Home Raffle ticket for $25, Buy (4) tickets for $100 - Get (1) ticket free 2.2 Ticket(s) - Tickets are $25 each suggested minimum donation. Any ticket purchase between September 15, 2009 12:00 a.m. CST to May 30th, 2010 5pm will be considered a valid purchase date ; Florida Home Raffles, LLC will reject any raffle ticket request if the check or credit card payment is not honored or is returned due to insufficient funds or any other reason prior and not remedied before the time of drawing. Correction any such return or non-payment is the sole responsibility of the ticket purchaser. Odds of winning depend on number of eligible entries received. All federal, state and local taxes associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner. Winner must claim prize with Florida Home Raffles, LLC and sign and deliver a completed W-9 form, or other form as required by law, to Florida Home Raffles, LLC no later than 5:00p.m. CST thirty (30) calendar days from announcement or first attempt to contact, or the prize will be forfeited and awarded to alternate winner, see section (4). Prize on transferable. No substitutions or exchanges (including for cash). Actual prize may vary from photos used in print. No entrant need be present or tour house to win. No purchase or contribution is necessary. Winner determined by random drawing from all eligible entries, to be held by Florida Home Raffles, LLC. Which, will notify winner by telephone or email and U.S. certified mail return receipt on drawing day. To claim prize, winner must follow the instructions contained in their notification. Winner must present two (2) forms of proper ID, one must be a valid state-issued driver's license or identification certificate or such other form as will provide proof the entrant's identity. 3. SELECTION OF WINNERS. Drawings. One (1) random drawing will be conducted by a representative of Florida Home Raffles, LLC, as described below. Entrants need not be present to win. All tickets will be verified and selected by a selected party. The winning ticket is scheduled to be drawn on June 01 , 2010 5p.m CST or within 45 days from the date that all tickets are sold. From a pool of all eligible ticket requests received. The winner need not be present to win. Winner name, not ticket numbers, will be called. The winner will be called by name and verified by matching the ticket with the information in the Florida Home Raffles, LLC records and the application form. All winners will be notified by telephone, email and certified mail, return receipt requested, information as provided at ticket purchase. Notification by telephone will be made day of drawing. Email and U.S. ceritified mail, return receipt notification will be made within 24 hours of drawing. 3.1 DRAWINGS: Ticket purchase deadline dates must be met to insure entry. GRAND PRIZE: The Grand Prize is the "Spring into Your New Home", a 3 bedroom and 1 and a half bathroom home approximately 1500 Square Feet Single Family Home, located at 218 Betty Road, Pensacola, FL 32507. The Grand Prize winner, assume all fees, local, state, and federal taxes, homeowners' association fees and transfer taxes and shall reimburse Florida Home Raffles, LLC for any fees associated with transfer of the Grand Prize home. Additional prizes include 10-$250 Winners, 20-$100 Winners, 2-$100 Gift Certificate to Simone Malls, 10- $25 Gas Cards, 10-$25 Restaurant Gift Certificates, 2-Toshiba Laptops, Diamond Engagement Ring & Diamond Guard, 2 Nights at Pensacola Beach Hotel, TOM TOM GPS Navigation, 2-Sony Play Station and Digital Camera Kodak Camera. A W-9 form must be completed by each winner. Any withholdings, if required, applicable to prize, will be required at the time of transfer of such prize to the winner. The Home is provided "as is", with no guarantees or warranties from Florida Home Raffles, LLC or any other individuals or entities associated with this raffle. Winner is advised to consult a professional tax advisor. Prize Pictures not necessarily actual prize pictures. Model home interior decorating and furnishings and artists renderings are for display purposes only and are included as part of the Grand Prize. Custom choices and upgrades are not available. Tax authorities may place a different value on the home for the purpose of determining any income, property, transfer, or other taxes that may be due from the Grand Prize winner. If any prize winner cannot be located by 5p.m., thirty (30) calendar days after the announcement or thirty (30) days after prize notification, whichever is greater, or if the winner deemed to be ineligible, such a winner will be deemed to have forfeited his/her prize and another winner will be selected for such prize. A list of winners may be obtained by writing to Florida Home Raffles, LLC or by visiting www.Floridahomeraffles.com List will be posted approximately 24 hours after final drawing. Requests in writing must be received or postmarked within seven days of the drawing and include a self-addressed, stamped envelope. The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions.
4. NOTIFICATION. Entrant(s) whose ticket number(s) are drawn at the Grand Prize drawings will be deemed the winner of the prize for that particular drawing ("Selected Entrant"). Selected Entrant will be notified by phone and/or U.S. mail using the information provided on the Entry Form or to the operator ("Notification"). If any Selected Entrant cannot be located or fails to return attempts to contact him/her by 5:00 p.m. thirty (30) days after Florida Home Raffles, LLC first attempt to contact him/her, such Selected Entrant will be deemed to have forfeited his or her prize and another Selected Entrant will be drawn. Each Selected Entrant must execute an affidavit of eligibility/liability/terms and conditions/publicity release ("Release"). Selected Entrant(s) must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning ticket, credit card used to purchase the ticket. Unless restricted by law, each Selected Entrant will be required to complete and return the Release within thirty (30) days of prize notification. The prize may be forfeited if Selected Entrant(s): (1) cannot be reached; (2) fails to obtain all signatures on the Release and to return documents in a timely manner as required pursuant to these Official Rules; or (3) cannot accept or receive prize for any reason. Winner must execute all required documentation to transfer title of property into his or her name, within the thirty (30) days of prize notification. Winners grant permission for the use of their names, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. In the event any selected entrant is found ineligible or forfeits the prize, as described in these Official Rules, an alternate drawing will be held within five (5) business days after verification. If the Selected Entrant is found ineligible, rules of alternate drawing governed by these Official Rules, and notification will be posted on the website immediately.
5. 500-Five Hundred Early Bird Tickets are available allowing the purchaser of 2 two tickets prior to November 15th, 2009 to earn one ticket free this may be expanded at the sole discretion of Florida Home Raffles, LLC. After this date additional free tickets will be made available one at a time for purchasers of (4) tickets at the same time. Refer-a-Friend requires 'friends' reference number to be entered at the time of purchase, cannot be done after a ticket has been purchased. Five individually different addresses, ticket holder names, purchasers names or method of payments are required as well as honored payments prior to issuance of free ticket.
6. GENERAL TERMS AND CONDITIONS. By entering the drawing, the entrant agrees to be bound by these Official Rules and the decisions of Florida Home Raffles, LLC which shall be final. Winners will be required to execute an affidavit of eligibility and a publicity release permitting Florida Home Raffles, LLC to use their name, photograph, likeness, and voice for promotional purpose in any media. All winners are required to present proof of identity satisfactory to Florida Home Raffles, LLC sole discretion that matches the name on the winning ticket. Neither Florida Home Raffles, LLC, its employees, founders, owners, investors or any sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, officers, directors, shareholders, members, representatives, or independent contractors or any of its affiliates are responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner's acceptance or use of any prize. Winner agrees to defend, indemnify and hold Florida Home Raffles, LLC., and/or sponsors and each of their respective officers, directors, shareholder, employees, agents and affiliates and identities, harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of the winner's acceptance or use of the prize. ALL PERSONAL INFORMATION COLLECTED BY FLORIDA HOME RAFFLES, LLC WILL BE USED FOR ADMINISTRATION OF THE RAFFLE. FLORIDA HOME RAFFLES, LLC WILL NOT SHARE, SELL, OR OTHERWISE DISTRIBUTE PERSONAL INFORMATION COLLECTED BY SPONSOR EXCEPT AS STATED ABOVE.
